Are you compliant? or should the question be… Are your suppliers compliant?
 
It’s December 2018 and mustard has recently taken its regular REC Compliance Test. This test needs to be taken and passed every 2 years. Min pass rate is 80%... mustards pass mark this year was 98%.
 
Now, the reason I am bringing this up is that I believe it to be very important that, we as a supplier of services to both candidates and companies, are up to scratch. Whilst there isn’t a legal obligation for us to be members of the REC (Recruitment and Employment Confederation) and for mustard to be monitored by a governing body but it really makes sure we are offering the very best service.  From a legal, professional and moral point of view there are NO negatives to being a member and holding ourselves up to the higher standards. 
 
Part of this is the Compliance test which as members we must complete and pass. We had over 60 questions to answer about the processes we follow, our understanding of the REC Code of Professional Practice and the Law around Recruitment & Employment. All of this helps back up the service levels that we offer YOU our clients and candidates. Having the REC stamp of approval means that we can consistently put our hands on our hearts and say we have not only done what we said we were going to do but gone about it in manner which is both Professional and lawful.
 
Recent changes in the law, yes GDPR, has really put a spotlight on some of the bad practices associated with recruitment firms. In particular the passing of people’s personal data without ‘Explicit Consent’… Principle 1 of the Code of Conduct is Respect for Law. This means that anyone either sending a CV to you or sending your CV out must have discussed all aspects of the company, whereabouts, role & possible responsibilities and then asking for and recording the consent for this to happen.
 
You can read the code here to see just how a compliant recruiter should uphold themselves whether they are a member of the REC or not. In the same way that you may be governed by the RIBA or ARB, perhaps the CIAT, RICS or the CSD, SBID or BIID
 
Quality of service is important to mustard not just the speed a CV can pinged across to you. Within this offering comes peace of mind that corners are not being cut because of some misunderstanding that the first person to send a CV owns it. Both client and candidate have a say in who represents them in the market place and we always get consent so it may be worth asking your supply their process. 
 
It certainly isn’t cheap hiring people and given their importance to the continuing success of your firm I would say it is paramount that there are no questions about the service your receive.
 
Having up to date and compliant terms & contracts also protects your rights and are there to protect you if ever there is complication or dispute.
